Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you and Lupo Ventures LLC dba Lupo Yacht (“Lupo Yacht,” “we,” “our,” or “us”). By accessing our website, requesting a charter, or using any of our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
Our Services
Lupo Yacht provides luxury yacht charter bookings, yacht sales and acquisitions, concierge marine services, private events on the water, and related maritime services in Miami, South Florida, the Caribbean, and other destinations. All services are subject to vessel availability, weather conditions, and applicable maritime regulations.
Booking & Reservations
Charter reservations are confirmed upon receipt of the required deposit and a signed charter agreement. Lupo Yacht reserves the right to decline any booking at its sole discretion. Final pricing is confirmed in writing prior to charter departure. Rates may vary based on vessel, duration, destination, and season.
Cancellation & Refund Policy
Cancellation terms are outlined in your individual charter agreement. Generally:
- Cancellations made 30 or more days before departure may be eligible for a partial refund of the deposit.
- Cancellations made within 30 days of departure are non-refundable unless the vessel is re-chartered for the same dates.
- Lupo Yacht is not liable for cancellations due to weather, mechanical issues, or circumstances beyond our control. We will make every reasonable effort to reschedule.
Guest Responsibilities
All guests aboard a Lupo Yacht vessel agree to:
- Follow all instructions from the captain and crew at all times.
- Comply with all applicable maritime laws, U.S. Coast Guard regulations, and port authority rules.
- Refrain from bringing prohibited substances, illegal items, or unauthorized firearms aboard.
- Treat the vessel, crew, and fellow guests with respect. Lupo Yacht reserves the right to terminate a charter without refund for violation of these terms.
Limitation of Liability
To the maximum extent permitted by law, Lupo Ventures LLC dba Lupo Yacht shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, personal injury, or property damage arising out of or in connection with the use of our vessels or services. Our total liability shall not exceed the total charter fee paid for the specific booking in question.
Intellectual Property
All content on this website — including text, images, logos, graphics, and branding — is the property of Lupo Ventures LLC dba Lupo Yacht and protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content without prior written consent.
Privacy
Your use of our services is also governed by our
Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully.
SMS / Text Messaging Terms
By opting in to receive SMS/text messages from Lupo Ventures LLC dba Lupo Yacht, you agree to the following:
- Transactional Messages: You may receive messages related to your account, services, or communications you have requested, including booking confirmations, charter reminders, and account notifications.
- Marketing Messages: With your separate explicit consent, you may receive marketing and promotional messages including special offers, seasonal promotions, and new fleet updates.
- Message frequency may vary.
- Message and Data rates may apply.
- You may opt out at any time by replying STOP to any message.
- For assistance, reply HELP to any message or contact us directly.
- Carriers are not liable for delayed or undelivered messages.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Miami-Dade County, Florida.
Changes to These Terms
Lupo Yacht reserves the right to update these Terms at any time. We will notify you of any significant changes by updating the “Last updated” date at the top of this page. Your continued use of our services following any changes constitutes your acceptance of the revised Terms.
